TERMS AND CONDITIONS OF SERVICE
Vicky's Crown Mobility Transport
Effective Date: December 18, 2024
ACCEPTANCE OF TERMS
By booking or using transportation services provided by Vicky's Crown Mobility Transport ("Company," "we," "our"), you ("Client," "you," "your") agree to these Terms and Conditions. If you do not agree, do not use our services.
Legal Guardian/Representative: If booking for someone else, you certify you have authority to accept these terms on their behalf.
SERVICES PROVIDED
Non-Emergency Medical Transportation (NEMT): We provide non-emergency medical transportation services in Georgia, including:
Transport to/from medical appointments
Dialysis transportation
Wheelchair-accessible vehicles
Ambulatory transportation
Medical equipment transport
Not Provided: Emergency medical services, ambulance services, or medical care during transport.
COMPLIANCE AND LICENSING
We operate under:
Georgia Department of Community Health NEMT regulations
Georgia Department of Public Safety transportation rules (GAC 570-38-4)
Federal Medicaid NEMT requirements (42 CFR 431.53)
Georgia Fair Business Practices Act (O.C.G.A. § 10-1-390 et seq.)
Insurance: We maintain required Georgia commercial vehicle insurance as mandated by law.
BOOKING AND SCHEDULING
Advance Notice: Non-urgent appointments require 72 hours (3 business days) advance notice. Same-day requests subject to availability and additional fees.
Confirmation: All bookings confirmed via phone, email, or text. Booking not guaranteed until confirmed.
Changes: Rescheduling permitted with 24+ hours notice (one free change per booking).
Accuracy: You must provide accurate information including:
Pickup/drop-off addresses
Appointment time
Mobility requirements
Contact phone number
PAYMENT TERMS
Payment Methods: Cash, check, credit/debit card, insurance, Medicaid.
When Due:
Medicaid/Insurance: Billed directly to payer
Private Pay: Payment due at time of service or as agreed
Recurring Services: Invoiced weekly/monthly as agreed
Late Payment: Accounts over 30 days past due subject to $25 late fee and 1.5% monthly interest (18% annual). Unpaid accounts may be sent to collections.
Disputed Charges: Must be raised within 30 days of invoice date.
CANCELLATIONS AND REFUNDS
Governed by our separate Refund and Cancellation Policy. Key points:
24+ hours notice: Full refund
Less than 24 hours: Partial refund with cancellation fee
No-show: Full charge, no refund
Medical emergencies: Fee waived with documentation

CLIENT RESPONSIBILITIES
You agree to:
Be ready at scheduled pickup time
Provide accurate medical/mobility information
Follow driver safety instructions
Wear seatbelts at all times
Respect driver and other passengers
Not consume alcohol/drugs before or during transport
Not bring weapons, illegal substances, or hazardous materials
Pay all applicable fees on time
Notify us immediately of schedule changes
CONDUCT AND SAFETY
Zero Tolerance: We maintain zero tolerance for:
Threatening, abusive, or violent behavior
Sexual harassment or inappropriate conduct
Intoxication or drug use
Smoking in vehicles
Damage to vehicles
Interference with driver operations
Consequences: Violation may result in:
Immediate service termination
No refund of fees paid
Ban from future services
Legal action if warranted
Charges for vehicle damage
Driver Authority: Drivers have authority to refuse transport or terminate service if client behavior poses safety risk. No refund provided.
VEHICLE OCCUPANCY
Passengers: Only pre-approved passengers permitted. Additional passengers require advance notice and may incur additional fees.
Escorts: One escort permitted at no charge when medically necessary (must be 18+).
Children: Minors must be accompanied by parent/guardian unless pre-authorized.
Service Animals: Permitted under ADA. Must be under control at all times.
Pets: Not permitted except service animals.
PROPERTY AND BELONGINGS
Personal Items: You are responsible for all personal belongings. We are not liable for lost, stolen, or damaged items.
Medical Equipment: We transport wheelchairs, walkers, oxygen tanks, and similar equipment at no additional charge. Equipment must be properly secured.
Left Items: Items left in vehicles held for 30 days. Unclaimed items donated or disposed of.
Prohibited Items: Weapons, illegal drugs, hazardous materials, excessive luggage.
LIABILITY AND LIMITATIONS
Reasonable Care: We exercise reasonable care in providing services but are not liable for:
Delays due to traffic, weather, road conditions, or vehicle issues
Missed appointments due to client lateness or circumstances beyond our control
Medical emergencies occurring during transport (we will call 911)
Acts of third parties or accidents not caused by our negligence
Loss of personal property
Insurance Coverage: We maintain Georgia-required commercial liability insurance. Insurance information provided upon request.
Maximum Liability: Our total liability limited to the amount paid for the specific trip in question, except where prohibited by law.
Medical Care: We do not provide medical care. Drivers trained in basic first aid but are not medical professionals.
FORCE MAJEURE
We are not liable for delays or inability to perform due to circumstances beyond our control, including:
Natural disasters (hurricanes, floods, severe weather)
Government orders or restrictions
Road closures or traffic emergencies
Public health emergencies
Acts of terrorism
Widespread power outages
Full refund provided for services unable to be performed due to force majeure.
PRIVACY AND CONFIDENTIALITY
HIPAA Compliance: We comply with HIPAA regulations as a Business Associate. Protected health information handled per our Privacy Policy.
Information Use: We collect and use information only as necessary to provide services and comply with legal requirements.

MEDICAID CLIENTS
Georgia Medicaid NEMT Program: For Medicaid clients:
No copayment required for eligible services
Must also notify NEMT broker (Modivcare or Verida) of cancellations
Excessive no-shows may affect transportation eligibility
Services must be medically necessary and pre-authorized
Broker Coordination: We coordinate with authorized NEMT brokers as required by Georgia Department of Community Health.
MODIFICATIONS TO SERVICES
Route Changes: Mid-trip destination changes require dispatcher approval and may incur additional charges.
Wait Time: Included wait time: 15 minutes. Additional wait time: $20 per 15 minutes (or portion thereof).
Additional Stops: Not included unless pre-arranged. Additional fees apply.
Service Upgrades: Wheelchair-accessible vehicles or special accommodations available upon request.
TERMINATION OF SERVICES
By Client: May terminate at any time. Prepaid services refunded per Refund Policy.
By Company: We reserve right to refuse or terminate service if:
Payment not received
Client violates terms and conditions
Client behavior poses safety risk
False information provided
Pattern of no-shows or late cancellations
Effect: Upon termination, client remains responsible for all fees incurred.

Governing Law: These terms governed by Georgia law. Any legal action must be brought in courts of Cobb Georgia.
No Class Actions: Disputes resolved individually, not via class action.
INDEMNIFICATION
You agree to indemnify and hold harmless Vicky's Crown Mobility Transport, its owners, employees, and drivers from claims, damages, or expenses arising from:
Your violation of these terms
Your conduct during service
Damage you cause to vehicles or property
False information you provide
Your violation of applicable laws
SEVERABILITY
If any provision deemed invalid or unenforceable, remaining provisions remain in full effect.
ENTIRE AGREEMENT
These Terms and Conditions, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Vicky's Crown Mobility Transport.
Prior Agreements: Supersedes all prior verbal or written agreements.
MODIFICATIONS
We may modify these terms at any time. Changes effective upon posting at vickyscrowntransport.com. Continued use of services constitutes acceptance.
Material Changes: Notification via email to active clients.
Existing Bookings: Subject to terms in effect when booked.

By using our services, you acknowledge that you have read, understood, and agree to these Terms and Conditions, our Privacy Policy, and our Refund and Cancellation Policy.
For Medicaid Clients: You also acknowledge understanding of Georgia Medicaid NEMT program requirements and broker coordination responsibilities.
